Below you will find a typical set of documents/information required for the execution of a notarial deed. However please note that the notary will specify a final set of documents required for a particular notarial deed only after she has familiarized herself with all aspects of the client’s case.

If the parties to the agreement are married and their financial affairs are governed by an agreement – official copy of the notarial deed of the marital property agreement.

If a party acts through an attorney – official copy of the power of attorney granted by the principal.

SALE OR GIFT OF LAND
  1. copy of an entry in the land and mortgage register,
  2. basis of acquisition, i.e. one of the following documents: official copy of the notarial deed (ex. sale agreement, gift agreement) or final and absolute judicial decision of the court confirming acquisition of the inheritance estate or deed of succession certification, in the case of inheritance or gift (received on 1 January 2007 or later) accompanied by the certificate from the tax office confirming that the heirs have met their tax obligations,
  3. personal details of buyers and sellers /donors and beneficiaries/ (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, place of permanent residence),
  4. additionally, for companies – current copy of an entry in the National Court Register [KRS], REGON company number, NIP tax number,
  5. proof of payment of real property tax or fee for the right of perpetual usufruct of the land,
  6. excerpt from the local zoning plan confirming the designation of the land or a certificate on the lack of it or a decision on the conditions of development,
  7. excerpt from the land register (with the excerpt from the survey map, in the case where a new land and mortgage register is established for a partitioned plot of land),
  8. final decision approving the division of the real property if the division is effected,
  9. map of the area for legal purposes (in the event of division),
  10. information whether the community council adopted a resolution on revitalization for a given area (in particular for real property located outside Warsaw),
  11. certificate that the plot of land is/is not covered by the simplified forest management plan (in particular for real property located outside Warsaw),
  12. certificate that the plot of land is/is not covered by the decision of starosta determining the scope of forest management in a given area issued on the basis of review of status of forests (in particular for real property located outside Warsaw),
  13. in the case of a gift, short official copies of civil registry certificates indicating the degree of kinship or affinity between the parties to the act,
  14. market value of the plot of land (sales price),
  15. manner of payment of the price (whether in installments, by within what time limits),
  16. terms and date of handover of the plot of land,
  17. bank account number to which the price shall be paid.
SALE OR GIFT OF PREMISES ENTERED TO THE LAND AND MORTGAGE REGISTER
  1. copy of an entry in the land and mortgage register,
  2. basis of acquisition, i.e. one of the following documents: official copy of the notarial deed (ex. sale agreement, gift agreement) or final and absolute judicial decision of the court confirming acquisition of the inheritance estate or deed of succession certification, in the case of inheritance or gift (received on 1 January 2007 or later) accompanied by the certificate from the tax office confirming that the heirs have met their tax obligations,
  3. personal details of buyers and sellers /donors and beneficiaries/ (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, registered place of residence),
  4. additionally for the companies – current copy of an entry in the National Court Register or Excerpt from the business register, REGON company number, NIP tax number,
  5. certificate that nobody is registered for residence in the apartment,
  6. certificate that there are no arrears in payment of rent and utilities,
  7. proof of payment of real property tax and/or fee for perpetual usufruct of land,
  8. in the case of a gift, short copies of civil registry certificates indicating the degree of kinship or affinity of the parties to the act,
  9. manner of payment of the price (whether in installments, and within what time limits),
  10. terms and date of handover of the premises,
  11. bank account number to which the price shall be paid.
SALE OR GIFT OF THE COOPEARTIVE OWNERSHIP TITLE TO THE PREMISES
  1. certificate from the cooperative that the party holds the title to the premises,
  2. basis of acquisition, i.e. one of the following documents: official copy of the notarial deed (ex. sale agreement, gift agreement) or final and absolute judicial decision of the court confirming acquisition of the inheritance estate or deed of succession certification, in the case of inheritance or gift (received on 1 January 2007 or later) accompanied by the certificate from the tax office confirming that the heirs have met their tax obligations,
  3. copy of an entry in the land and mortgage register if it has been established,
  4. personal details of buyers and sellers /donors and beneficiaries/ (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, registered place of residence),
  5. additionally for the companies – current copy of an entry in the National Court Register or Excerpt from the business register, REGON company number, NIP tax number,
  6. certificate that nobody is registered for residence in the apartment,
  7. certificate that there are no arrears in payment of rent and utilities,
  8. in the case of a gift, short copies of civil registry certificates indicating the degree of kinship or affinity of the parties to the act,
  9. market value of the premises (sales price),
  10. manner of payment of the price (whether in installments, and within what time limits),
  11. terms and date of handover of the premises,
  12. bank account number to which the price shall be paid.
LAST WILL AND TESTAMENT
  1. personal details of the testator (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, registered place of residence, date and place of birth),
  2. personal details of beneficiaries (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, registered place of residence, date of birth),
POWER OF ATTORNEY TO SELL REAL PROPERTY
  1. personal details of the principal (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, NIP tax number, registered place of residence),
  2. personal details of the attorney (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, registered place of residence),
  3. description of the real property, ideally – copy of an entry in the land and mortgage register or other documents.
DEED OF SUCCESSION CERTIFICATION
  1. death certificate of the testator,
  2. Last Will and Testament of the testator, if applicable,
  3. information on the last usual place of residence of the testator (last place of residence)
  4. civil registry certificates of heirs: birth certificates or marriage certificates (married women),
  5. personal details of interested parties participating in the act (names, surname, parents’ first names, marital status, ID card or passport number and expiry date, PESEL, registered place of residence),
  6. certificate of the deceased’s PESEL number.
MARITAL PROPERTY AGREEMENT
  1. Short copy of marriage certificate,
  2. Personal details of spouses (names, surname, parents’ first names, ID card or passport number and expiry date, PESEL, registered place of residence).
